By accessing or using ChartBrain.io (“the Service”), you agree to be bound by these Terms of Use. If you do not agree, you may not use the Service. We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance of the revised terms.

2. Description of Service

ChartBrain.io provides real-time stock market heatmaps, charting tools, AI-powered indicators, portfolio tracking, watchlists, price alerts, and an AI trading assistant. The Service is available in multiple subscription tiers (Free, Starter, Pro, and AI Max) with varying feature sets.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete registration information and to notify us immediately of any unauthorized use.

4. Subscription and Billing

Paid subscriptions are billed monthly through Stripe. You may cancel at any time; your access continues through the end of the current billing period. Refunds are handled on a case-by-case basis. The Free tier does not require a credit card and has no expiration date.

5. Intellectual Property

All content, code, design, and proprietary AI indicators (CB Momentum Score, CB Trend Strength, CB Anomaly Detector, CB Support/Resistance AI, CB Forecast Cone) are the intellectual property of ChartBrain.io. You may not copy, distribute, reverse engineer, or create derivative works without written permission.

6. Third-Party Services and Attribution

The Service integrates with third-party providers including Polygon.io (market data), Stripe (payment processing), Supabase (authentication and database), and Postmark (email delivery).

Our charting functionality is powered by TradingView’s Lightweight Charts library, an open-source project licensed under the Apache License 2.0. TradingView is a trademark of TradingView, Inc. ChartBrain.io is not affiliated with, endorsed by, or sponsored by TradingView, Inc.

7. Data and Investment Disclaimer

ChartBrain.io is not a financial advisor. The Service provides market data and analysis tools for informational purposes only.

Nothing on this platform constitutes investment advice, a recommendation to buy or sell any security, or a solicitation of any kind. All AI-generated analysis, indicator readings, and alerts are computational outputs based on historical data and statistical models — they are not predictions and should not be treated as such.

Trading and investing involve risk, including the possible loss of principal. You are solely responsible for your own investment decisions. Always do your own research and consult a licensed financial advisor before making investment decisions.

8. Limitation of Liability

To the maximum extent permitted by law, ChartBrain.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses, arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account at any time for violation of these terms or any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and associated data at any time by contacting us.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved through binding arbitration.
